The Process
Often, people are intimidated by the legal world because the system and the language associated with it can seem complicated. Therefore, when we founded Why Litigate, our first commitment was to put our clients at ease with the process. This gives them confidence to work through their issues and feel comfortable about how things work.
If you’re involved in a legal matter and want to explore alternatives to litigation, we make it simple:
- First, contact Michael Herman, our Program Director, by calling 508-556-0513. Michael worked in the Worcester Probate and Family Court for 38 years. He is skilled at asking the questions needed to determine how we can assist you
- Once you and Michael have discussed the information that is pertinent to your case and the services we can provide, he will decide which member of our team is best suited to assist you.
- Michael will schedule a meeting with you and that member of our team. At that meeting you’ll review the facts to facilitate the best resolution to your case.

When presented a choice most people choose dispute resolution services over litigation through the courts. Once they understand the options, the believe they can achieve one or more of these goals:

Options
At Why Litigate, we offer three dispute resolution options – mediation, conciliation, and private adjudication. Our experienced team will help you choose the one that best suits the circumstances of your particular legal situation.
Mediation Services
Mediation is a process in which an experienced attorney assists the parties to clarify their issues and discuss options for resolution. Mediation works to obtain a settlement that is acceptable to both parties irrespective of the strengths and weaknesses of their case. Learn more here
Conciliation Services
Conciliation is a process in which an experienced attorney assists the parties in settling their case. They clarify the issues and assess the strengths and weaknesses of each side. If the case is not fully settled by conciliation, the attorney helps the parties explore the steps which remain to prepare their case for trial. Learn more here
Private Adjudication Services
Private Adjudication is a process in which an experienced attorney renders a decision after hearing the parties’ respective positions and reviewing evidence. The process may take place through a formal hearing with the presentation of evidence. Or, it may come in a less formal manner, when the facts are presented through the parties or their lawyers.
